A Nashville judge has ordered District Attorney Glenn Funk to publicly publish on June 9 the Tennessee Bureau of Investigation’s file on a deadly police shooting in East Nashville’s James A. Cayce Homes public housing community.
The TBI report details the agency’s investigation of the shooting death of Clemmons on Feb. 10. Nashville Police Officer Joshua Lippert shot and killed 31-year-old Clemmons in the James A. Cayce Homes public housing complex in East Nashville, according to police.
Earlier this month, Funk announced he would not prosecute the officer. And he also asked a judge to allow him to release of the TBI’s investigative file.
At the time of Clemmons’ death, TBI’s files were confidential unless a judge ordered their release.
Chancellor Ellen Hobbs Lyle previously said she would allow the TBI’s investigation to become public, and set in a Tuesday court filing the following timeline for that to happen:
June 2: District attorney should complete redactions, removing personal info from the report, and notify the judge
June 9: The investigative file should be posted on the DA’s website
July 10: The file should be removed from the DA’s website Lyle says in a Tuesday order that the file should not be given to her, which prevents it from becoming public record before the above deadlines.
She does not say why there is a week-long buffer between when redactions are done and when the file becomes public.
The judge also does not say why the report must be taken down after about a month.
On May 5, Gov. Bill Haslam signed a measure that says future TBI investigations of officer-involved shooting deaths should become public record after a prosecutor decides whether to press charges.
